DA VANCE ANNOUNCES INDICTMENT OF THOMAS GILBERT, JR., FOR MURDER OF HIS FATHER

Defendant Shot and Killed Victim Inside Family’s Midtown Apartment

Manhattan District Attorney Cyrus R. Vance, Jr., today announced the indictment of THOMAS GILBERT, JR., 30, for fatally shooting his father with a semiautomatic pistol inside his parents’ Manhattan apartment. The defendant is charged in an indictment in New York State Supreme Court with Murder in the Second Degree and Criminal Possession of a Weapon in the Second Degree, among other charges. [1]

“As alleged in the indictment, the defendant intentionally shot and killed a member of his own family,” said District Attorney Vance. “He also possessed a private cache of ammunition and firearm attachments that might have enabled him to do even more tragic harm. The presence of deadly weapons can escalate any situation involving domestic or family violence.”

According to the indictment and statements made on the record in court, at approximately 3:15 p.m. on January 4, 2015, GILBERT, JR. shot his 70-year-old father, Thomas Gilbert, Sr., in the head with a .40-caliber Glock, placing the semiautomatic pistol on the victim’s body before leaving the apartment.

NYPD investigators later executed a search warrant at GILBERT, JR.’s apartment in Chelsea and recovered loose .40-caliber ammunition, a .40-caliber Glock magazine loaded with eight rounds, an additional magazine loaded with nine more bullets, an owner’s manual and carrying case for a Glock pistol, and several firearm enhancements, including a speed loader designed for a Glock handgun, a cable lock, and a red dot sight attachment. Two empty shell casings forensically matching the firearm left at the crime scene were also discovered at the defendant’s apartment, in addition to a credit card skimmer and more than 20 blank cards. 

Assistant District Attorney Craig Ortner, Deputy Chief of Trial Bureau 60, is handling the prosecution of this case, with the assistance of Assistant District Attorneys Craig Ascher and Peter Casolaro, under the supervision of William Mahoney, Chief of Trial Bureau 60, and Executive Assistant District Attorney John Irwin, Chief of the Trial Division. 

District Attorney Vance also thanked the NYPD 17th Precinct Squad and the Manhattan South Homicide Squad for their assistance with the investigation.
