Manhattan District Attorney Robert M. Morgenthau announced today that a 21-year-old man was indicted for raping one woman on the Upper West Side and a second woman in East Harlem. The defendant was arrested as a result of a DNA “cold hit” matching the DNA evidence with the defendant's DNA profile in the New York State DNA Databank. The first attack occurred on May 13, 2006 near 600 West 58th Street at approximately 2:00 AM. Two males, KEVIN RIOS and an unapprehended individual, entered the victim’s van. One of the men pointed a gun at the victim and both defendants sexually assaulted the victim. RIOS stole the victim’s purse, which contained money and identification. The second unapprehended man is still being sought. The investigation is continuing. RIOS’ DNA was recovered from the crime scene location of the May 13, 2006 incident and also matched DNA recovered from the January 30, 2008 incident. ###
