Manhattan District Attorney Robert M. Morgenthau announced today the indictment of a former New York City Police Department (NYPD) officer for sexually assaulting a woman in a Manhattan hotel. The defendant, KEVIN JOHNSON, 28, was assigned to the 73rd Precinct in Brooklyn since his appointment in January 2007. He resigned from the NYPD on June 4, 2008. JOHNSON has been charged with rape and multiple counts of sexual abuse. The crimes charged in the indictment occurred on April 29, 2008. The investigation leading to today’s indictment revealed that the victim and friends were staying at a hotel in the Flatiron District. The women went out for dinner and then to a bar, where they met JOHNSON. The defendant, who was off-duty, identified himself as a police officer. The victim’s friend brought the defendant back to the hotel room, while the victim left for a period of time. The victim returned, noticed the defendant was still in the room, and went to sleep in the bathroom. While the victim was sleeping, JOHNSON sexually assaulted her. The victim and her friends immediately contacted the NYPD. The defendant has been indicted for Rape in the First Degree, a class B felony, which is punishable by up to 25 years in prison, as well as three counts of Sexual Abuse in the First Degree, a class D felony, which is punishable by up to seven years in prison. Mr. Morgenthau thanked the Internal Affairs Bureau and the New York City Police Department for their assistance in the investigation. Assistant District Attorney Jonathan Lenzner presented the case to the grand jury and will be in charge of the prosecution, under the supervision of Assistant District Attorney Lisa Friel, Chief of the Sex Crimes Unit. Senior Investigator Edward Tacchi also assisted in this matter. ###
