D.A. Also Dismisses Existing Prostitution Matters Before the Office, Including 900 Cases Dating Back to 1970s, and All Loitering for the Purpose of Prostitution Cases Following New York’s Repeal of “Walking While Trans”
Manhattan District Attorney Cy Vance, Jr., today announced the Office’s new policy to decline-to-prosecute prostitution and unlicensed massage, and appeared virtually in Manhattan Criminal Court and moved to dismiss 914 Prostitution and Unlicensed Massage cases – in line with the Office’s new policy – preventing unnecessary future contacts with the criminal justice system, eliminating the collateral consequences associated with having a prostitution case or conviction, and empowering New Yorkers to interact with law enforcement without fear of arrest or deportation. D.A. Vance also moved to dismiss 5,080 Loitering for the Purpose of Prostitution cases, following New York State’s repeal of the statute known as “Walking While Trans” earlier this year.
“Over the last decade we’ve learned from those with lived experience, and from our own experience on the ground: criminally prosecuting prostitution does not make us safer, and too often, achieves the opposite result by further marginalizing vulnerable New Yorkers,” said District Attorney Vance. “For years, rather than seeking criminal convictions, my Office has reformed its practice to offer services to individuals arrested for prostitution. Now, we will decline to prosecute these arrests outright, providing services and supports solely on a voluntary basis. By vacating warrants, dismissing cases, and erasing convictions for these charges, we are completing a paradigm shift in our approach. These cases – many dating back to the 1970s and 1980s – are both a relic of a different New York, and a very real burden for the person who carries the conviction or bench warrant.
“With today’s dismissals, we also close the book on Loitering for the Purpose of Prostitution, known as the ‘Walking While Trans’ for its decades of discriminatory enforcement, unfairly targeting members of the LGBTQ+ community. I was proud to support the repeal of this bill, and thank Senator Brad Hoylman, Assemblywoman Amy Paulin, and the many, many survivors and advocates who fought to put an end to this practice. Indeed, none of this would have been possible without the tireless work of dedicated individuals who changed not only our laws, but law enforcement’s understanding of their lived experiences.

Previously, the D.A.’s Office’s policy was to dismiss prostitution cases in the interest of justice after the charged individual completed five counseling sessions with service providers.
The Manhattan D.A.’s Office identified 5,994 cases in its records dating back to 1976 where there was (1) an open bench warrant and (2) a top charge of:
- Prostitution (PL 230.00), a B misdemeanor;
- “Unlicensed Massage” (Attempted Unauthorized Practice of a Profession in the context of offering massage services without a license, PL 110/ED 6512(1)), an A misdemeanor; or,
- Loitering for the Purpose of Prostitution (PL 240.37), a class B misdemeanor.
Today, District Attorney Vance appeared before Judge Charlotte Davidson and moved to vacate the 5,994 bench warrants en masse, and to dismiss the 878 underlying Prostitution cases and 36 underlying Unlicensed Massage cases, in accordance with the Office’s new policy to decline to prosecute any such arrests. D.A. Vance also moved to dismiss 5,080 underlying Loitering for the Purpose of Prostitution cases, following New York State’s repeal of the statute earlier this year.
The Legal Aid Society’s Abigail Swenstein joined D.A. Vance in his motions, which were granted by Judge Davidson.
In moving to dismiss today’s cases, District Attorney Vance stated the following in court:
Good morning, Your Honor,
Thanks to the tireless work of survivors and advocates, the crime of Loitering for the Purpose of Prostitution, which for decades unfairly targeted many vulnerable and underserved communities, has now been removed from our penal code. By repealing Penal Law 240.37 earlier this year, the legislature has recognized that the conduct that was the subject of the statute should not be criminalized.
Although my office has not prosecuted this crime since 2016, we have identified 5,080 cases where the top charge is Loitering for the Purpose of Prostitution and there is a pending bench warrant.
The interests of justice demand that we address these matters, and they are now before the Court.
My office recognizes that the vulnerabilities imposed by warrants relating to the Loitering for the Purpose of Prostitution charge apply equally to many of the people who are charged with prostitution and unlicensed massage.
We therefore have identified every case where the top charge is Penal Law 230.00 and there is a pending bench warrant. There are a total of 878 cases that meet this criteria, and they are before the Court as well.
We’ve also identified 36 cases where individuals are charged with Attempted Unauthorized Practice of a Profession in the context of offering massage services without a license, and these cases are also before the Court this morning.
Many of these warrants were issued at a time when we did not recognize the circumstances that these individuals were facing. In many of these matters, vulnerable people have faced significant collateral consequences, and live even now under the threat of being detained based on pending bench warrants.
In collaboration with survivors, advocates, and the Legal Aid Society’s Exploitation Intervention Project, we have undergone a paradigm shift in our understanding of these issues and of the lived experiences of people who have been charged with these offenses.
Given what we have learned in the decades since some of these warrants were issued, and in light of the fact that my office will not prosecute these charges going forward, the interests of justice now demand that we also address these matters.
Therefore, at this time, as to Calendar Numbers 1 through 5,994, the People move to vacate the bench warrants on all matters, to vacate the pleas on cases where there has been a plea, and to dismiss each of these cases because we can no longer prove them beyond a reasonable doubt.
The full text of the new Decline-to-Prosecute Policy, which is believed to be the first in New York State, follows:
Over the last decade, we have undergone a paradigm shift in how we understand the experiences of those engaging in prostitution and unlicensed massage. Through the work of our Human Trafficking Response Unit, and through the relationships we have built with survivors, sex workers, and advocates, we have come to a better understanding of the unintended harms of charging individuals with these offenses. To complete the paradigm shift, beginning today, the Office will no longer charge individuals with the offenses of Prostitution (P.L. § 230.00) and attempted or completed Unauthorized Practice of a Profession in the context of unlicensed massage (charged under PL § 110/E.D § 6512(1)), as a standalone charge or in conjunction with other charges. This policy does not preclude us from bringing other charges that may stem from a prostitution-related arrest. Any arrest involving these charges should be referred to the Human Trafficking Response Unit. In cases where they are the sole charge, the Human Trafficking Response Unit will complete all necessary paperwork to formally decline to prosecute these cases and will arrange for information about voluntary services to be provided to the person arrested, but these services will no longer be mandated.
Declining to Prosecute Low-Level Offenses
Since 2010, D.A. Vance has cut the Office’s total prosecutions by more than half by ending the routine prosecution of marijuana smoking and possession, subway fare evasion, unlicensed vending, nonpayment of fines, loitering for prostitution, peaceful protest, and summons cases.
