Manhattan District Attorney Cyrus R. Vance, Jr., today announced the indictment of EUGENE MILLER, 32, for fatally shooting his ex-girlfriend, 30-year-old Rosetta Ewell, in the hallway outside of their child’s Harlem daycare center in July 2015. The defendant is charged in a New York State Supreme Court indictment with one count of Murder in the Second Degree.
“This cold-blooded shooting of Rosetta Ewell, a young mother of two, truly shocks the conscience,” said District Attorney Vance. “Unwilling to accept that Ms. Ewell ended their relationship, this defendant allegedly lay in wait as she dropped off their two-year-old daughter at daycare, before confronting her and shooting her multiple times in the face just outside of the daycare’s entrance.
“Though gun violence may seem synonymous with street crime, domestic violence and gun violence are inextricably linked: between 2003 and 2012, more U.S. women were killed by an intimate partner with a firearm than with all other weapons combined. These links necessitate further study, which is why Prosecutors Against Gun Violence, a non-partisan group I co-founded with Los Angeles City Attorney Mike Feuer, convened for a summit on the intersection of domestic violence and gun crimes last October. As District Attorney, tackling gun crime and domestic violence are top priorities, and my Office will continue to seek justice for victims like Ms. Ewell, and to help spare others from the same violence.”
According to court documents and statements made on the record in court, beginning at approximately 8:00 a.m. on July 24, 2015, MILLER hid in the staircase of the West 139th Street building where he knew Ms. Ewell, his ex-girlfriend with whom he had two children in common, would soon be arriving to drop off their two-year-old daughter. Ms. Ewell arrived approximately an hour later, and dropped off their child. As she waited for the elevator, the defendant emerged from the staircase, confronted the victim, and shot her three times in the face. MILLER fled, and was apprehended in October 2015 by members of the NYPD’s Manhattan Warrants Squad.
Assistant District Attorney Dafna Yoran is handling the prosecution of this case with Assistant District Attorney Jennifer Sigall, under the supervision Executive Assistant District Attorney John Irwin, Chief of the Trial Division. Paralegal Rachel Rothberg is assisting with the case.
District Attorney Vance thanked the 32nd Precinct Detective Squad for its assistance with the investigation.
