Manhattan District Attorney Cyrus R. Vance, Jr., today announced the indictment of DAVID BARIL, 30, for using a hammer to assault four individuals over a three-day period, including one police officer. The defendant is charged in New York State Supreme Court with Attempted Murder in the First Degree, Assault in the First Degree, and Attempted Aggravated Assault upon a Police Officer, among other charges. 
“The seemingly random and unprovoked nature of the alleged assaults makes the defendant’s actions particularly alarming,” said District Attorney Vance. “Any object can be used as a weapon in the hands of someone with the intent to do harm, but thanks to the bravery of the officers involved, this individual was stopped before he could continue his violent spree through Manhattan and cause even more damage.”
According to documents filed in court and statements made on the record in court, at approximately 1:45 p.m. on May 11, 2015, BARIL approached a group of four people near West 35th Street and 6th Avenue and attempted to engage them in conversation. When the group moved away from him, BARIL used a hammer to strike one of the individuals, causing the 20-year-old victim to suffer lacerations to the back of his head. The defendant left the area and headed south on 6th Avenue.
Approximately six hours later, BARIL used a hammer to attack a 28-year-old woman seated on a bench in Union Square Park, striking her in the head. The defendant fled—and no more than five minutes later—attacked a third victim, approaching her from behind on West 17th Street near 6th Avenue and using the same hammer to bash the 33-year-old woman in the back of the head.
Two days later, at approximately 10:00 a.m. on May 13, 2015, Police Officer Lauren O’Rourke and Police Officer Geraldo Casaigne approached the defendant at the corner of West 37th Street and 8th Avenue. BARIL then removed a hammer from his pocket and struck repeatedly at Officer O’Rourke’s head, shoulder, and back before her partner was able to subdue the defendant with multiple gunshots to the defendant’s body.
Assistant District Attorney David Drucker is handling the prosecution of the case, under the supervision of Assistant District Attorney Warren Murray, Chief of Trial Bureau 50, and Executive Assistant District Attorney John Irwin, Chief of the Trial Division. Assistant District Attorneys Courtney Groves and Lisa Franchini are providing additional assistance with the case, under the supervision of Assistant District Attorney Eugene Porcaro, Chief of Trial Bureau 30.
 The charges contained in the indictment are merely allegations, and the defendant is presumed innocent unless and until proven guilty. All factual recitations are derived from documents filed in court and statements made on the record in court.
