Manhattan District Attorney Cyrus R. Vance, Jr., today announced the sentencing of SANJAY TRIPATHY, 48, to seven years in state prison for the brutal assault, strangulation, and sexual assault of a woman he met through a website at the W Hotel in Times Square. On May 30, 2018, a New York State Supreme Court jury found the defendant guilty of each count in the indictment against him, including Criminal Sexual Act in the First Degree, Sexual Abuse in the First Degree, and Assault in the Second Degree.
“This powerful executive sought to silence this survivor and invalidate her testimony, exploiting the power imbalance between them and falsely insisting that his torturous acts were consensual,” said District Attorney Vance. “He thought that police, prosecutors, and jurors would believe that her significant bruising, chipped tooth, and blood in the hotel room simply amounted to rough-housing. Thankfully, the jury saw these acts for what they were – a horrifically cruel sexual assault. I would like to thank my Office’s Sex Crimes Unit for its continued commitment to justice for survivors of sexual violence.”
As proven at trial, TRIPATHY met the survivor through the website SeekingArrangment. At approximately 10:30 p.m. on June 15, 2016, TRIPATHY — then a technology executive who was visiting New York for business — and the victim had been drinking at a bar at the W Hotel in Times Square when he invited her upstairs to his hotel room. Later, inside of the room on the hotel’s 49th floor, TRIPATHY became aggressive after the victim asked to leave and threw her onto the bed, placed his hands on her neck, and sexually assaulted her. The woman then tried to leave through the hotel room door when the defendant dragged her toward the bed and punched her several times in the face and head, causing bruising to her face and eyes, a bloody nose, and a chipped tooth. TRIPATHY also strangled the woman, causing bruising to her neck and chest, and sexually assaulted her again.
The victim was finally able to flee at approximately 12:40 a.m. the following morning and immediately alerted police outside of the hotel. NYPD apprehended TRIPATHY outside of his hotel room shortly thereafter, and the victim was taken to a local hospital where she was treated for her injuries.
Assistant D.A.s Kristen Baraiola and Martha Bashford, Chief of the Sex Crimes Unit, handled the prosecution of the case under the supervision of Executive Assistant D.A. John Irwin, Chief of the Trial Division.
District Attorney Vance thanked the NYPD for its assistance with the case, specifically Sergeant Douglas Schack and Police Officers Edwin Li and Yan Poon of Patrol Borough Manhattan South; Detective Anthony Ribustello of the Crime Scene Unit; and Detectives Christopher Jones, John Moglia, and Thomas McNamara of the Midtown North Precinct Squad.
